This report provides an overview of the final drafts of the Omeo and Swifts Creek Structure Plans, including how each plan was developed and the key recommendations and seeks their adoption. Structure plans are high-level planning documents that provide strategic land use policies and strategies for a particular town, in this case, Omeo and Swifts Creek. Structure plans also identify further detailed work and provide a strong basis for grant funding. Once both structure plans are adopted, they will be implemented into the East Gippsland Planning Scheme via a Planning Scheme Amendment which is planned to commence in 2027. The draft Omeo Structure Plan is provided at Attachment 1 and draft Swifts Creek Structure Plan is provided at Attachment 2.

This report seeks Council’s approval of planning permit application 5.2025.361.1 which is for the ‘Use and development of a medical centre, removal of vegetation, display of business identification signs and creation of access to a road in a Transport Road Zone 2’, located at 236 Bullumwaal Road Wy Yung. The report outlines the proposal and details the rationale behind the officer’s recommendation for approval. It is noted that this matter was heard at the 18 August 2026 Council Meeting wherein a motion to approve the Officers recommendation to approve the planning permit with conditions was defeated (5 against, 3 support, 1 abstain). In accordance with the Planning and Environment Act 1987, Council as the responsible planning authority has the options to (a) to grant a permit, (b) to grant a permit subject to conditions, or (c) to refuse to grant a permit on any planning ground it thinks fit. Whilst the motion to approve the planning permit was defeated, no formal decision has been made on the planning permit application as no other motion was moved. Therefore, this report is coming back before Council to enable a decision to be made on the planning application, noting that the Officer’s recommendation has not changed but that Council can move a motion to refuse the application if they choose.
